These Terms of Use (“Terms”) govern your access to and use of the TheirLight mobile application (“TheirLight” or the “App”), provided by AngelGrace Technologies, LLC (“AngelGrace Technologies,” “we,” “us,” or “our”).

By downloading, accessing, creating an account for, or using TheirLight, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About TheirLight

TheirLight is a mobile application designed to help individuals and families preserve and celebrate memories of people and pets who have touched their lives.

The App may provide features that allow users to create memorials, preserve memorial cards and Prayer Cards, record life stories and meaningful details, remember important dates, create keepsakes, establish family connections, share memorials with other users, receive reminders and Daily Reflections, associate songs with memorials, search for cemetery information, and use other remembrance-related features.

Features may be added, modified, improved, or discontinued as TheirLight evolves.

2. Eligibility and Your Account

You must be at least 13 years old to create or use a TheirLight account. If applicable law requires a higher minimum age for you to consent to these Terms or to the processing of your personal information, that higher age applies.

You are responsible for providing accurate information when creating and maintaining your TheirLight account and for maintaining the confidentiality and security of your account credentials.

You are responsible for activity conducted through your account.

3. 30-Day Trial

TheirLight may be downloaded from the Apple App Store without an initial purchase and may provide eligible users with a 30-day full-function trial.

During the trial period, you may access the functionality made available as part of the trial.

The trial is intended to provide an opportunity to experience TheirLight before deciding whether to purchase permanent access.

Trial eligibility and status may be determined using information made available through Apple's App Store and StoreKit services.

The trial does not automatically convert into a recurring subscription.

4. One-Time Purchase

After the trial period ends, continued access to TheirLight's functionality requires a $19.99 one-time purchase, subject to the price displayed by Apple in the App Store at the time of purchase.

This purchase provides permanent access to the applicable version and functionality of TheirLight made available under the purchased entitlement, subject to these Terms and continued availability of the App and supporting services.

TheirLight does not use a recurring subscription for this purchase. There are no recurring TheirLight subscription charges.

Purchases are processed by Apple through the App Store. AngelGrace Technologies does not directly process or store your complete payment-card information.

Prices, taxes, currencies, and other purchase terms may vary by country or region and are governed by the applicable Apple App Store purchasing process.

5. Trial Expiration and Saved Information

When your 30-day trial expires, access to TheirLight functionality may be restricted until the one-time purchase is completed.

Expiration of the trial does not automatically delete your TheirLight account or supported information stored in the cloud.

This allows you to purchase TheirLight later and regain access to supported saved information associated with your account.

Deleting the App from your device or signing out of your account does not by itself delete your TheirLight account or supported cloud-stored information.

6. Restore Purchase

TheirLight may provide a Restore Purchase function that uses Apple's StoreKit services to identify eligible previous purchases associated with your Apple account.

Restoration of purchases is dependent upon Apple's systems and the availability and validity of the applicable App Store purchase entitlement.

7. Refunds and App Store Transactions

Purchases made through TheirLight are processed through Apple's App Store.

Requests for refunds, payment disputes, transaction questions, and other App Store purchase matters are generally handled by Apple according to Apple's applicable policies and terms.

AngelGrace Technologies does not control Apple's approval or denial of refund requests.

8. Memorial and Prayer Card Limits

TheirLight currently supports up to 100 memorials owned by an account at one time.

Memorials shared with you by another TheirLight user do not count toward your 100-owned-memorial limit.

TheirLight currently supports up to 15 saved Prayer Cards per account. A Prayer Card counts as one saved item whether it contains only a front image or both front and reverse images.

Deleting an owned memorial or Prayer Card may free capacity for another item, subject to the App's current functionality.

These limits may be modified in future versions of TheirLight when reasonably necessary for technical, operational, security, or service reasons.

9. Your Content

TheirLight allows you to enter, upload, create, preserve, and share information, photographs, memorial-card images, Prayer Cards, stories, notes, and other content (“User Content”).

You retain ownership of User Content to the extent that you have ownership rights in that content.

By storing User Content through TheirLight, you give AngelGrace Technologies the limited rights necessary to host, process, reproduce, transmit, display, synchronize, back up, and otherwise handle that content solely as reasonably necessary to operate and provide TheirLight and its features.

AngelGrace Technologies does not acquire ownership of your User Content merely because you store it through TheirLight.

10. Responsibility for Content

You are responsible for the User Content you add to TheirLight.

AngelGrace Technologies does not routinely review, verify, or independently confirm the accuracy, ownership, legality, or appropriateness of User Content. The availability of content through TheirLight does not mean that AngelGrace Technologies endorses or verifies it.

You agree that you will not knowingly use TheirLight to store or share content that you do not have the right to use or share; violates another person's intellectual property, privacy, publicity, or other rights; is unlawful, fraudulent, threatening, abusive, defamatory, or intentionally harmful; contains malicious software or code; or is used to interfere with or compromise TheirLight or its supporting systems.

Because TheirLight may contain information about family members and other living individuals, you should use care when entering personal or sensitive information about others.

11. Sharing Memorials

TheirLight may allow you to share access to certain memorials with other TheirLight users.

You are responsible for deciding whom you share memorial information with and for ensuring that you have an appropriate right or basis to share that information.

Information made available to another person through a sharing feature may be viewed by that person according to the functionality provided by TheirLight.

AngelGrace Technologies cannot control information that another person independently records, copies, exports, prints, photographs, or otherwise retains after receiving authorized access to it.

12. Photos, Memorial Cards and Prayer Cards

You may choose to photograph or import images for supported TheirLight features.

You are responsible for ensuring that you have the right to use images you upload or preserve through the App.

TheirLight's ability to identify, scan, extract, or interpret information from an image may not always be accurate. You should review extracted information and make any necessary corrections before relying on it.

Original physical documents and photographs should be retained when they are important to you. TheirLight should not be treated as the sole archival copy of irreplaceable original materials.

13. Keepsakes, Printing and Sharing

TheirLight may allow you to create memorial keepsakes and other personalized materials that can be saved, shared, or printed.

The appearance of printed or shared materials may vary depending on the printer, paper, device, operating system, software, or third-party service used.

You are responsible for reviewing a keepsake before printing or sharing it.

14. Notifications and Reminders

TheirLight may provide optional notifications and reminders, including Daily Reflections and reminders associated with birthdays, anniversaries, or other remembrance dates.

Notifications depend on device settings, Apple services, operating-system behavior, permissions, and other technical factors outside AngelGrace Technologies' control.

TheirLight notifications should be treated as convenience features and should not be relied upon as the sole method of remembering an important date or event.

15. Cloud Storage and Synchronization

TheirLight uses cloud services to provide supported account, synchronization, restoration, database, and image-storage functionality.

Although we take reasonable measures designed to protect and maintain the service, no cloud or electronic-storage system can guarantee uninterrupted availability or absolute protection against data loss.

You should maintain independent copies of irreplaceable photographs, memorial cards, documents, and other important original materials.

16. Third-Party Services

TheirLight relies on certain third-party platforms and services, including services provided by Apple and Google Firebase.

Certain features may depend on those services being available and functioning properly.

Third-party services are governed by their own applicable terms and privacy practices. AngelGrace Technologies does not control the operation, availability, policies, or future changes of third-party services.

17. Privacy

Your use of TheirLight is also subject to the TheirLight Privacy Policy.

The Privacy Policy explains how information associated with TheirLight is collected, used, stored, shared, protected, retained, and deleted.

18. Account Deletion

TheirLight provides a Delete My Account function.

Deleting your account is different from signing out or deleting the App from your device.

When account deletion is completed, TheirLight is designed to delete the associated account and supported cloud-stored information under AngelGrace Technologies' control, subject to information that may need to be retained for legitimate legal, security, fraud-prevention, transaction-record, or other lawful purposes.

Account deletion does not automatically cancel, reverse, or refund an App Store transaction.

19. Intellectual Property

TheirLight, the AngelGrace Technologies name, the TheirLight name and branding, application design, software, graphics, original text, original reflections, and other content provided by AngelGrace Technologies are protected by applicable intellectual-property laws.

Except for your own User Content and as otherwise permitted by law, you may not copy, reproduce, distribute, sell, modify, reverse engineer, or commercially exploit TheirLight or AngelGrace Technologies content without authorization.

20. Copyright and Content Complaints

If you believe content stored or shared through TheirLight infringes your copyright, privacy, publicity, or other legal rights, please contact AngelGrace Technologies at support@angelgracetechnologies.com and provide enough information for us to identify the content and understand the basis of your concern.

We may review, restrict access to, preserve, or remove content when reasonably necessary to investigate a complaint, comply with applicable law, enforce these Terms, or protect the rights or safety of users or others.

Nothing in this section represents that AngelGrace Technologies has qualified for any particular statutory safe harbor. Any formal copyright notice or takedown procedure required by applicable law will be handled in accordance with applicable requirements.

21. Acceptable Use

You agree not to attempt to gain unauthorized access to TheirLight, another user's account, or supporting systems; circumvent trial, purchase, account, security, or usage controls; interfere with the operation or security of the App; use automated methods to abuse or overload the service; use TheirLight for unlawful purposes; or attempt to extract, copy, or exploit the App's software except where permitted by applicable law.

22. AI-Generated Scenery Artwork

Certain scenery artwork displayed within TheirLight may be generated using artificial-intelligence technology.

Such scenery is provided for decorative and aesthetic purposes and is not intended to depict a specific real-world location, cemetery, person, event, or historical scene unless expressly identified otherwise.

23. No Professional Advice

TheirLight is a memorial and remembrance application. Information and features provided through the App are not intended as legal, financial, medical, mental-health, religious, funeral-directing, cemetery, or other professional advice.

You should consult an appropriate qualified professional when professional advice is needed.

24. Availability and Changes to TheirLight

We work to provide a reliable service, but we do not guarantee that TheirLight will always be available without interruption or error.

The App or particular features may occasionally be unavailable because of maintenance, updates, technical problems, third-party-service outages, security requirements, or circumstances outside our reasonable control.

We may update, improve, modify, replace, or discontinue features as TheirLight evolves.

25. Disclaimer of Warranties

To the extent permitted by applicable law, TheirLight is provided on an “as is” and “as available” basis.

AngelGrace Technologies does not warrant that the App will be uninterrupted, completely error-free, completely secure, or suitable for every particular purpose.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded under applicable law.

26. Limitation of Liability

To the maximum extent permitted by applicable law, AngelGrace Technologies will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of, inability to use, or reliance upon TheirLight.

To the maximum extent permitted by applicable law, the total aggregate liability of AngelGrace Technologies arising out of or relating to TheirLight or these Terms will not exceed the greater of (a) the amount you paid to AngelGrace Technologies for TheirLight during the twelve months immediately preceding the event giving rise to the claim or (b) fifty U.S. dollars (US $50).

These limitations apply only to the extent permitted by applicable law. Nothing in these Terms limits liability, remedies, warranties, or consumer rights that cannot legally be limited or excluded.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless AngelGrace Technologies, LLC from third-party claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful or intentional misuse of TheirLight, your material violation of these Terms, or User Content you provide that infringes or violates another person's intellectual property, privacy, publicity, or other legal rights.

This provision does not require you to indemnify AngelGrace Technologies for claims caused by AngelGrace Technologies' own conduct to the extent such an obligation would be prohibited by applicable law.

28. Suspension or Termination

We may restrict or terminate access to TheirLight when reasonably necessary to protect users, comply with law, protect the security or integrity of the service, address fraudulent or abusive activity, or enforce these Terms.

You may stop using TheirLight at any time and may delete your account using the functionality provided in the App.

29. Changes to These Terms

We may update these Terms as TheirLight evolves, our business or services change, or legal or regulatory requirements change.

When we update these Terms, we will revise the Last Updated date above. When appropriate or legally required, material changes may also be communicated through the App or by other reasonable means.

Your continued use of TheirLight after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

30. Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law principles, except to the extent applicable law provides otherwise.

Nothing in these Terms deprives you of mandatory consumer protections that apply to you under applicable law.

31. Apple

If you obtain TheirLight through Apple's App Store, you acknowledge that these Terms are between you and AngelGrace Technologies, LLC, not Apple.

Apple is not responsible for providing TheirLight or for providing maintenance or support for the App, except to the extent required under Apple's applicable terms or applicable law.

Your use of TheirLight must also comply with applicable Apple App Store terms.

32. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

33. Entire Agreement

These Terms, together with the TheirLight Privacy Policy and any additional terms presented for a particular feature or purchase, constitute the agreement between you and AngelGrace Technologies concerning your use of TheirLight and related services, except for applicable agreements with Apple or another third-party service provider.
